The Heritage Kitchener Committee held a meeting this date commencing at 4:01 p.m.

The Committee considered Development Services Department report DSD-2023-189 dated April 11, 2023, recommending approval of Heritage Permit Application HPA-2023-V-003 for the property municipally addressed as 44 Theresa Street to permit the demolition and reconstruction of the front porch, additions to the shed dormer, repair/replacement of windows and doors, and demolition of the detached garage.

J. Viera presented an overview of the staff report, noting the proposed work will allow a vacant and derelict single-detached home to be used as a functional and maintained duplex. G. Stevenson, Interim Director of Planning was also in attendance to respond to questions from the Committee. 

M. Thach, thinkform architecture + interiors inc., was in attendance in support of the subject application and the staff recommendation. In response to questions from the Committee, M. Thach stated the shed dormer design was chosen opposed to an addition to the back of the structure, to provide clear sight lines, and minimal change to the structure itself.

On motion by P. Ciuciura

  • it was resolved:

    "That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-2023-V-003 to permit:

      1. The demolition and reconstruction of the front porch with minor design changes;
      2. The addition of two shed dormers on the roof of the dwelling;
      3. The repair or replacement of multiple windows and doors on all façades; and
      4. The demolition of the rear yard detached garage and creation of a rear parking pad to accommodate additional parking spaces; and,

    That the property municipally addressed as 44 Theresa Street be approved, as outlined in Development Services Department report DSD-2023-189, in accordance with the supplementary information submitted with the application and subject to the following conditions:

      1. That a material sample board be submitted to Heritage Planning staff for review prior to the issuance of a building permit;
      2. That the vegetation in the front yard be maintained as a visual buffer where feasible; and
      3. That final building permit drawings be reviewed, and heritage clearance provided by Heritage Planning staff prior to the issuance of a building permit."
    Carried unanimously

The Committee considered Development Services Department report DSD-2023-154, dated March 28, 2023 recommending Notice of Intention to designate 181 Frederick Street as being of cultural value or interest, under Part IV of the Ontario Heritage Act. 

Counsellor C. Michaud entered the meeting at this time. 

D. Choudhry provided a brief overview of the Staff report, noting heritage designation of the property was made a condition of the site plan application. G. Stevenson was also in attendance to respond to questions from the Committee. 

D. Choudhry was in contact with the property owner, and while they are not in attendance this date, they have expressed support with designating the subject property. 

In response to questions from the Committee, D. Choudhry stated if the Notice of Intention to Designate is approved by the Committee and Council, and the corresponding designating by-law has passed, a plaque will be installed at the property site to recognize the heritage property designation. D. Choudhry noted no additional plaque is required as a condition of the site plan at this time. 

In response to further questions, D. Choudhry noted a site plan was submitted in 2019, related to construction of a 10-story condominium adjacent to 181 Frederick Street. As a requirement of this site plan application, a Heritage Impact Assessment (HIA) was requested, confirming the property's design, historical and contextual value. Staff recommended based on the results of the HIA, the property should be designated under Part IV of the Ontario Heritage Act. 

D. Choudhry also verified in response to questions from the Committee that the exterior heritage attributes of the property will be preserved, and it will continue to function as an office.

It was noted any recommendation arising from this matter would be considered at Council on May 8, 2023

    it was resolved:

    "That pursuant to Section 29 of the Ontario Heritage Act, the Clerk be directed to publish a Notice of Intention to Designate the property municipally addressed as 181 Frederick Street as being of cultural heritage value or interest, as outlined in Development Services Department report DSD-2023-154."

R. Schwarz entered the meeting at this time. 

The Committee considered Development Services Department report DSD-2023-170, dated April 11, 2023 recommending Notice of Intention to designate 73 Shanley Street as being of cultural value or interest, under Part IV of the Ontario Heritage Act. 

J. Vieira provided a brief summary of the report. J. Vieira noted there is no associated site plan application for the property, and stated the heritage designation process was initiated by the property owner. G. Stevenson was also in attendance to respond to questions from the Committee. 

J. Vieira noted correspondence with the property owner occurred, and while they are not in attendance this date, they have expressed support with designating the subject property. 

In response to questions from the Committee, G. Stevenson stated there is no intention to designate the entire neighborhood at this time. G. Stevenson stated through the Growing Together program, all central Major Transit Station Areas (MTSA) are being reviewed, and staff are analyzing the possibility of implementing parts of the cultural heritage landscape. G. Stevenson noted heritage matters concerning the Mount Hope/Breithaupt area will be reviewed through the Growing Together Program in December 2023.

It was noted any recommendation arising from this matter would be considered at Council on May 8, 2023

  • it was resolved:

    "The pursuant to Section 29 of the Ontario Heritage Act, the Clerk be directed to publish a Notice of Intention to Designate the property municipally addressed as 73 Shanley Street as being of cultural heritage value or interest, as outlined in Development Services Department report DSD-2023-170."

J. Vieira provided an update regarding the Municipal Heritage Register (MHR) noting, staff are in the process of reviewing the first 10 assessments, provided by the Committee Member field evaluations. J. Vieira conveyed staff's intention to provide 10 statements of significance for the June 2023 Heritage Kitchener Committee meeting, and stated 10 new property's will be assigned to Committee Members in June for the purpose of conducting field assessments.

In response to questions from the Committee, staff clarified their expected timelines to bring forward the Notice of Intention to Designate to the Committee and Council for the first 10 properties, following the statements of significance.
