The Heritage Kitchener Committee held a meeting this date commencing at 4:02 p.m.

A. Portengen declared a pecuniary interest with respect to Heritage Permit Application HPA-2024-IV-08, 10 Duke Street West, Partial Demolition with Retention of Front, East, and portion of the West Side Façade, Construction of 45-Storey Mixed-Use Building, DSD-2024-160 on the agenda this date as his employer is involved in the proposed construction for this property. Accordingly, A. Portengen did not participate in any discussion or vote regarding this matter.

I. Bodendorfer declared a pecuniary interest with respect to Draft Heritage Impact Assessment (HIA) - Hidden Valley Secondary Plan – Land Use Implementation Project , DSD-2024-193 on the agenda this date as their family member resides within the subject area. Accordingly, I. Bodendorfer did not participate in any discussion or vote regarding this matter.

The Committee considered Development Services Department report DSD-2024-147, dated May 7, 2024 regarding a Heritage Impact Assessment (HIA) for the property municipally addressed as 2091 Bleams Road. 

D. Choudhry presented an overview of the Draft Heritage Impact Assessment (HIA), advising it was completed in relation to a demolition control application for a future plan of subdivision. D. Choudhry advised, the subject property is not designated nor is it a non-designated property of cultural heritage value or interest on the Kitchener Municipal Heritage Register. However, the property is identified within the Rosenberg Community Secondary Plan as a potential cultural heritage resource. D. Choudhry indicated staff in attendance this date are seeking the Committee's feedback on the Draft HIA. G. Stevenson, S. Bassanese and M. Drake were also in attendance to respond to questions from the Committee.

G. Smith, MHBC Planning provided a presentation in support of the staff recommendation. D. Currie, MHBC Planning was also in attendance to respond to questions from the Committee.

The Committee suggested further consideration be given for rejuvenation of the subject log house rather than demolition as there are only a few log houses remaining in the City of Kitchener. The Committee also noted the subject log house appears to be structurally sound thus may not require demolition. The Committee further noted homes possessing heritage characteristics should be maintained to prevent them from falling into a state of disrepair to the point of demolition. The Committee noted the HIA was provided in draft version thus requested the consultant provide the final version of the HIA once it is available.

The Committee considered Development Services Department report DSD-2024-193, dated May 7, 2024 regarding a Heritage Impact Assessment (HIA) for Hidden Valley Road. The road is not designated nor is it as a non-designated property of cultural heritage value or interest on the Kitchener Municipal Heritage Register, however, the road has been identified as a rural road Cultural Heritage Landscape (CHL) and a potential cultural heritage resource in the City of Kitchener Official Plan.

D. Choudhry presented an overview of the Draft Heritage Impact Assessment (HIA), advising it was submitted to the City of Kitchener in 2023 as part of various technical studies being conducted to inform the Hidden Valley Secondary Plan. As part of the HIA, a specific portion of Hidden Valley Road was recommended to be evaluated to determine its cultural heritage value or interest and for it to potentially be considered as a “Heritage Corridor”. D. Choudhry indicated staff in attendance this date are seeking the Committee's feedback on the Draft HIA. G. Stevenson, S. Bassanese, M. Drake and C. Musselman were also in attendance to respond to questions from the Committee.

P. Young and K. Jonas, Archeological Research Associates Ltd. were in attendance to respond to questions from the Committee. In response to questions from the Committee, K. Jonas noted "significant views" were identified as heritage attributes in the Hidden Valley area thus, the City may wish to consider impacts that proposed future developments may have on these views.

In response to further questions from the Committee, C. Musselman noted natural areas identified in the Land Use Master Plan map have been approved by the Kitchener's City Council however, the boundaries of these areas may be modified based on findings of technical studies that are currently underway.

Accordingly, A. Portengen did not participate in any discussion or vote regarding this matter.)

The Committee considered Development Services Department report DSD-2024-160, dated April 22, 2024, recommending approval of a Heritage Permit Application (HPA) HPA-2024-IV-08 to permit a partial demolition excluding the front, east, and a portion of the west side façade of a building to facilitate the construction of a 45-Storey Mixed-Use Building on the property municipally addressed as 10 Duke Street West. The subject property is currently listed as a non-designated property of cultural heritage value or interest on the Kitchener Municipal Heritage Register. 

M. Drake presented an overview of the report noting the HPA is being submitted in anticipation of a proposed redevelopment of the subject property where portions of the building are to be demolished and the retained portions are to be integrated into the podium of a proposed 45-storey mixed-use building. Further, M. Drake noted a Draft Heritage Impact Assessment (HIA) was completed as part of the site plan application for this proposed work and was presented to the Heritage Kitchener Committee in December 2021. Additionally, a Notice of Intention to Designate the subject property was published in Record on April 12, 2024 and the designating by-law is intended to be presented to Kitchener City Council on May 27, 2024.

G. Stevenson, S. Bassanese and M. Drake were also in attendance to respond to questions from the Committee.

C. Bogdanski, mcCallumSather and J. Dee, John G. Crooke and Associated Ltd. provided a presentation in support of the Staff recommendation and responded to questions from the Committee.

In response to questions from the Committee, G. Stevenson noted, the subject property is listed on the Kitchener Municipal Heritage Register and must receive heritage designation by the end of 2024 in order to meet the heritage designation deadline outlined in the Ontario Heritage Act. Further, the proposed development has received conditional site plan approval which includes a requirement for the property to be designated as being of cultural heritage value or interest. As such, heritage designation of the subject property is required to be in effect prior to the partial demolition and construction of the proposed development. It was also noted, the applicant is actively fulfilling site plan approval conditions and intends to begin construction in 2024, if feasible.

In response to further questions from the Committee, M. Drake noted, as outlined in the staff report, alternative development options including retention of the entire building was explored during the planning process however, it was determined this would not be feasible due to the size of the site, the relative size and position of building on site, and the construction and load-bearing capabilities of the existing building. Relocation of the building was also explored but was determined not to be a desirable approach due to the loss of the contextual value.

It was noted the recommendation arising from this matter would be considered at the Council meeting taking place on May 27, 2024.

    "That pursuant to Sections 30(2), 33, and 34 of the Ontario Heritage Act, Heritage Permit Application HPA-2024-IV-08 for the property municipally addressed as 10 Duke Street West be approved to permit the partial demolition of the building, excluding the front (south) façade, east side façade, and part of the west side façade; and, the construction of a 45-storey mixed-use building with retained portions of the original building integrated into the podium, subject to the following conditions, as outlined in the Development Service Department report DSD-2024-160:

      1. That the final Heritage Impact Assessment be submitted and approved by the Director of Development and Housing Approvals prior to the issuance of the heritage permit;
      2. That the final Conservation Plan, including a Salvage and Documentation Plan and Commemoration and Interpretation Plan, be submitted and approved by the Director of Development and Housing Approvals and the City’s Heritage Planner prior to the issuance of the heritage permit;
      3. That the final Temporary Protection Plan, including a Demolition and Stabilization Plan and Structural Assessment Report, be submitted to the satisfaction of the City’s Manager of Development Review and the City’s Heritage Planner prior to the issuance of a Heritage Permit;
      4. That the final Risk Management Plan, including the Vibration Monitoring Report, be submitted to the satisfaction of the City’s Manager of Development Review and the City’s Heritage Planner prior to the issuance of a Heritage Permit;
      5. That final building elevations be submitted for review to the satisfaction of the City’s Manager of Development Review in conjunction with Heritage Planning Staff and Urban Design Staff prior to the issuance of the heritage permit;
      6. That the final demolition permit be reviewed, and heritage clearance provided by Heritage Planning Staff prior to the issuance of a demolition permit; and,
      7. That the final building permit be reviewed, and heritage clearance provided by Heritage Planning Staff prior to the issuance of a building permit."

The Committee considered Development Services Department report DSD-2024-195, dated April 12, 2024 recommending a Notice of Intention to Designate 131 Victoria Street South as being of cultural heritage value or interest, under Part IV of the Ontario Heritage Act be published.

M. Drake presented an overview of the report. G. Stevenson and S. Bassanese were also in attendance to respond to questions from the Committee.

It was noted any recommendation arising from this matter would be considered at the Council meeting taking place May 27, 2024.

The Committee considered Development Services Department report DSD-2024-210, dated April 24, 2024 recommending a Notice of Intention to Designate 87 Scott Street and 82 Weber Street East as being of cultural heritage value or interest, under Part IV of the Ontario Heritage Act be published.

It was noted any recommendation arising from this matter would be considered at the Council meeting taking place on May 27, 2024.

The Committee considered Development Services Department report DSD-2024-194, April 1, 2024 recommending the cultural heritage value or interest be recognized, and designation be pursued for the following properties: 113-151 Charles Street West / 170-188 Joseph Street / 3-44 Francis Street South, 83-85 King Street West, 87-91 King Street West, 97-99 King Street West, 148 Madison Avenue South, 171-173 Victoria Street North and 111 Ahrens Street West.

M. Drake and D. Choudhry presented an overview of the report. G. Stevenson and S. Bassanese were also in attendance to respond to questions from the Committee.

It was requested that a motion for each property be voted on separately.

It was noted that pending the Committee's approval, Staff will contact the subject property owners advising of the intention to designate.
